between you ("Student", "you", "your") and Sky High Training
("we", "us", "our", "Company") governing your enrollment in
and use of our BTEC Level 2 ICQ Certification training courses
for taxi and private hire drivers.
By enrolling in our courses, accessing our website, or
using our services, you acknowledge that you have read,
understood, and agree to be bound by these Terms and all
applicable laws and regulations in the United
Kingdom.
If you do not agree with these Terms, you must not enroll in
our courses or use our services.

3. Eligibility and Enrollment

4. Course Fees and Payment Terms
4.1 Course Fees
The fees for our BTEC Level 2 ICQ Certification course will be

4.2 Payment Methods

4.6 Late Payment
Late payments may incur:
- Late payment fees of £25 per week

Suspension of access to course materials and training

- Referral to debt collection agencies
- Legal action to recover outstanding amounts
4.7 VAT
All fees are inclusive of VAT (Value Added Tax) at the current
UK rate, where applicable. Educational courses may be
VAT-exempt under certain circumstances.
5. Cancellation, Refunds, and Cooling-Off Period
5.1 Cooling-Off Period (Consumer Rights)
Under the Consumer Contracts (Information, Cancellation and
Additional Charges) Regulations 2013, you have the right to
cancel your enrollment within 14 days from the date of
enrollment without giving any reason.
To exercise your right to cancel, you must inform us in

5.2 Refund Policy - Student Cancellation
5.2.1 Cancellation Before Course Commencement

refund minus £50 administrative fee

7-14 days before start date: 50% refund

5.2.2 Cancellation After Course Commencement
Once the course has started, no refunds will be provided
except in exceptional circumstances at our sole discretion
(e.g., serious illness with medical documentation,
bereavement).
5.3 Company Cancellation
We reserve the right to cancel or postpone courses due to:
- Insufficient enrollment numbers
- Instructor unavailability
- Force majeure events (see Section 15)
- Facility issues or safety concerns
If we cancel a course:
- You will receive a full refund of all fees paid
- We will offer alternative course dates if available

We are not liable for any consequential losses or expenses
5.4 Refund Processing
Approved refunds will be processed within 14 days of receipt
of your cancellation notice and will be paid to the original
payment method used.

third parties

6. Course Delivery and Schedule

dates, times, and locations, with reasonable notice (minimum
48 hours). We will make every effort to accommodate students
affected by schedule changes.
6.5 Course Materials

Students are responsible for:

Maintaining and returning borrowed materials in good
condition
- Replacing lost or damaged materials at cost

7. Assessments, Examinations, and Certification
7.1 Assessment Requirements
To successfully complete the course and receive certification,
students must:
- Complete all required coursework and assignments
- Pass all practical assessments

Pass written examinations with the minimum required score
- Demonstrate competency in all required skill areas
- Meet attendance requirements
7.2 Examination Conduct
During examinations and assessments, students must:

Follow all instructions from instructors and invigilators
- Not engage in any form of cheating or plagiarism
- Not use unauthorized materials or assistance
- Maintain silence and respect for other students
- Submit work on time
Academic Misconduct: Any form of cheating,
plagiarism, or dishonesty will result in immediate failure of
the assessment and may lead to expulsion from the course
without refund.
7.3 Failed Assessments and Retakes
If you fail an assessment or examination:

You will be eligible for one free retake (subject to
Awarding Body policies)

Additional retakes will incur a fee of £[amount] per attempt

Appeal assessment results within 14 days of notification
Appeals must be submitted in writing to

evidence. Appeals will be reviewed in accordance with the
Awarding Body's policies.
8. Student Conduct and Responsibilities
8.1 Code of Conduct
Students are expected to:
- Behave professionally and respectfully at all times

Treat instructors, staff, and fellow students with courtesy

Refrain from discriminatory, abusive, or threatening
behavior
- Not engage in harassment, bullying, or intimidation
- Comply with all health and safety regulations

Not attend classes under the influence of alcohol or drugs

- Respect Training Centre property and equipment

Maintain confidentiality of other students' personal

8.2 Health and Safety
Students must:

- Not bring dangerous items or weapons onto premises
- Comply with emergency evacuation procedures
8.3 Technology and Device Use

- Silence mobile phones during training sessions

Not record audio or video without instructor permission
- Use computers and technology responsibly
- Not access inappropriate or offensive content
- Protect login credentials and not share accounts
8.4 Disciplinary Action
Breach of conduct may result in:

classes

9. Intellectual Property Rights

- Training manuals and handbooks
- Presentations and lecture notes
- Videos, images, and multimedia content
- Practice examinations and assessments
- Website content and design
- Logos, trademarks, and branding
are the exclusive property of Sky High Training or our
licensors and are protected by UK and international copyright,
trademark, and intellectual property laws.
9.2 Limited License
We grant you a limited, non-exclusive, non-transferable
license to access and use course materials solely for personal
educational purposes in connection with your enrollment.
You may NOT:
- Copy, reproduce, or distribute course materials
- Sell, rent, or license materials to third parties
- Modify, adapt, or create derivative works
- Use materials for commercial purposes
- Remove copyright or proprietary notices
- Share login credentials or online access
9.3 Awarding Body Materials
Materials provided by BTEC/Pearson or other Awarding Bodies
are subject to their respective terms and conditions.
Unauthorized use or reproduction may constitute copyright

9.4 Student Work
You retain ownership of original work you create during the
course (assignments, projects, etc.). However, by submitting
work, you grant us a non-exclusive license to use it for
educational, assessment, and quality assurance purposes.

We are committed to protecting your personal data in

paid by you for the course.

Decisions made by the Awarding Body regarding certifications

Licensing decisions made by local authorities (councils,
DVLA, etc.)
- Actions or services of third-party providers

Employment decisions made by taxi companies or private hire

11.4 Student Responsibility

Successful completion of the course does not guarantee
employment

Obtaining a taxi or private hire license requires separate
application to local authorities

Additional requirements may be imposed by licensing

You are responsible for meeting all legal requirements to
work as a taxi or private hire driver
12. Indemnification
You agree to indemnify, defend, and hold harmless Sky High
Training, its directors, officers, employees, instructors, and
agents from and against any and all claims, liabilities,
damages, losses, costs, and expenses (including reasonable
legal fees) arising from:
- Your breach of these Terms and Conditions
- Your violation of any law or regulation
- Your violation of the rights of any third party
- Your misconduct or negligent acts

Your use of the certification after completion of the course
13. Complaints and Dispute Resolution
13.1 Complaints Procedure
If you have a complaint or concern, please follow this
procedure:
Step 1 - Informal Resolution
Contact your course instructor or our Student Services team to
discuss the issue informally.
Step 2 - Formal Written Complaint
If the issue is not resolved, submit a formal written
complaint to:

13.2 Alternative Dispute Resolution
If we cannot resolve a dispute through our complaints
procedure, we both agree to attempt mediation before pursuing
legal action. We will jointly appoint a mediator and share
costs equally.
13.3 Legal Action
Any legal disputes arising from these Terms shall be subject
to the exclusive jurisdiction of the courts of England and
Wales.

You may not assign, transfer, or delegate your rights or

these Terms to a successor entity in the event of a merger,
